Employers' Liability Insurance

All employers, domestic as well as commercial, have a legal responsibility to provide a safe working environment for their employee/s. Under the Employers' Liability (Compulsory Insurance) Act 1969 all employers must ensure they have a suitable Employers Liability Insurance policy to cover themselves against claims made by employees or former employees. If your employee has sustained an injury or illness as a result of their work or working environment they may try to claim compensation and this is where an Employers' Liability Insurance policy would come in.

The legal requirement is to be covered for a minimum of £5M but bear in mind that the £5M minimum also covers costs so it's worth having an indemnity of more than this. The Enable Insurance Services policy covers our clients for a minimum indemnity of £10M, so you can be confident of having the right cover from the start, at a fixed price, low cost premimum of £99 for an annual policy. If your nanny has already begun working for you, don't delay. The cost of an annual policy is insignificant compared to the potential fines you may face if caught without one. When you receive your Certificate of Insurance keep it safe and display it somewhere (either physically or electronically) where your nanny can see it. 

And finally, while it is not mandatory to keep out-of-date certificates it is advisable to do so for a while, just in case of claims by anyone who may have left your service who worked for your while that policy was in force.

The Policy also includes £5m Public Liability Insurance

Anyone can take out Public Liability Insurance (PLI) as it provides protection for the policyholder should any claims be brought against them by members of the public, for accidents or damages to property.

In the case of employers it also covers them should an employee be responsible for an accident or damages whilst they are carrying out their duties. Similarly, it will also provide protection should the policyholder's child/ren be responsible for any accident or damage whilst they are out in public.

PLI is not a legal requirement, but it does provide extra reassurance, particularly if your employee's duties involve them being in a public place, as is often the case with nannies who are required to take the children out and about.

A PLI policy is usually purchased separately, however, Enable Insurance Services is delighted to be able to include PLI with an indemnity of £5M, as a standard part of our Employers Liability Insurance policy. Our clients will have that little extra peace of mind at no extra cost.
